I know what its like to wade into the weeds of issues… like your issue with the sidewalks and trees. Its exhausting. You feel like you are swimming against a tide. What has always disappointed me is that the state can find legions of sycophantic intellectuals, lawyers and other functionaries to do its bidding. I lost my hospital privileges at the Valley Hosp system in northern New Jersey because I never took any of those Covid shots. And I waited into a legal cesspool. Ultimately, I was able to get privileges at another local hospital, the holy name hospital in Teaneck with a religious exemption with the help of a lawyer in Florida named Jeffrey Childers, who writes a Substack called “coffee and Covid”
I followed various supreme court cases and other New Jersey state cases very carefully over the years. I will remember the Obamacare decision here the the government was claiming the right to force private citizens to buy a private product and to penalize them if they did not. Hardly less constitutional more immoral provision could be imagined, and yet it was OK with more than half the justices.
Then we came to these Covid vaccine mandates and healthcare mandates, and the judges on the Supreme Court prove themselves to be morons
One cannot imagine a more failed public institution in human history then the Supreme Court of the United States. The constitution does not need to be interpreted. It’s not written in Chinese. It needs to be enforced. And this body has failed miserably over the last hundred plus years.
Unlike the Criminal Code, there are no penalties specified for violating the US Constitution. There are no "Enforcers."
You need a Red Queen to declare "Off With Their Heads!", which was one reason for the Declaration of Rights and subsequent adoption of The Constitution.
So, as Mr. Oshinskie relates, the abusers use public money to defend their abuse.
You did not get a "religious 'exemption.'" What you got with attorney Jeff Childers' help was the recognition of your preexisting right to accommodation of religious expression. The law requires this -- and no emergency voids it -- despite what the criminals and freaks have done.
The law requires employers to make accommodation for medical reasons or religious conviction. The only way out? The employer must assert and then prove "undue hardship" in making the accommodation.
Again, you did not get a "get out of jail free" card. What you got was your legal right to the accommodation of your religious conviction.
Holy Name has historically marched to a different tune than the big corporate systems. They were at one time, the hospital that gave a reasonably welcoming home to a local midwifery practice. Midwifery and non medicalized birth practices, were like ivermectin to covid: shunned by corporate run practices which profit from interventions like inductions and caesarean sections, or ventilators and Remdesivir.
Well medicine and surgery work just like the law my friend. What Coronamania has shown us is that most lawyers, politicians and government employees have no basic science skills. Medicine is really becoming a new mechanism for government to really completely control areas it was never given authority. Look at the number of people employed by healthcare. Its staggering.
My first job out of training I worked tirelessly for the health system / hospital. Created care protocols, rounded in nursing homes, brought in new techniques and improved the overall quality of care by measurable/huge amounts. None of this I was even paid for or received any compensation. Then after 7 years a new CEO arrives and I was told "the. hospital is not going to build with you anymore". They hired additional physicians paid them huge salaries and essentially made it impossible for me to practice -- so I had to move on. Four years of school, 7 years clinical training, 7 years of hard clinical practice --- no discussion, no rights as a medical staff member - and people want to know why health care is so ineffective and expensive. People who run healthcare for the most part have no real clue how care is delivered.
"The hospital is not going to build with you anymore." Where do they come up with these sentences ... explanations?
We do need good and principled lawyers ... but the vast majority of plaintiff lawyers are also captured. That is, these "fearless" litigators "fighting injustice" ... know exactly what cases they can file ... and which ones they never can.

Health care has become just another industry in which the manager class can inflict their idiocy without check. The concept that if you can manage X then you can manage anything still chills me.

Your story reminds me that courage like you display is not the norm. Cowardice is the default human condition. Especially in America. Our desire to live comfortably is a powerful fertilizer for growing cowardice.

Painting with a broad brushstroke, there is nothing special about American humans as compared to the humans in the rest of the world. I know this won't be popular especially on the Fourth of July, but the truth is, the Declaration of Independence notwithstanding, there is no such thing as "inalienable rights". If someone bigger, stronger, or more powerful than you can take your "rights" away, and there is no one to stop them, your rights are not "inalienable". We have agreed to exist under this fiction and for most people most of the time, it works.
It always boggles me when I hear someone say "get a lawyer." That tells me A) that person is able to afford a lawyer and B) they have never really been in a situation where they (or their family member) are over their head legally and financially. The truth is, unless you have means, and unless you have a winnable case, good luck finding a lawyer who will even give you the time of day. Even free consultations are often a joke. You may find, as I have, that the lawyer is more interested in going over their files or some other thing than actually listening to you. And they will never ever give you a straight answer yes or no. They will string you along and string you along for that $300/hour as long as they can milk that cow. That is, if there is any milk to be had, otherwise, forget it. And please do not talk to me about Legal Aid unless you or someone close to you has had extensive personal experience with Legal Aid. There are a lot of people out there whose eyes have been rudely opened when they find out the realities of their situation. I remember about ten years back I attended a meeting of parents whose children had been caught up in the legal/penal system and OMG the stories they had to tell! Nothing had ever prepared them for what they were facing now. The helplessness in the face of an indifferent judicial/penal system. The frustration. It's not at all like you see on TV or the movies or in books. Your best defense is to STAY OUT of the courts and the legal system.
It's true that one's rights can be violated, but rights exist by virtue of one's humanity and are inseparable from it. Rights can be respected or violated, but neither created nor destroyed. A murder victim's right to life has been violated, but he had a right to life by virtue of his humanity, and without that right no guilt can be assigned to his murderer. If rights aren't inalienable, if they aren't a function and requirement of our nature as humans, then there's no guilt possible for the criminal who violates them and his victims have no grounds to object.

As to your ending thought, I think it's both - God is in charge, and there is strength in numbers. One of my biggest disappointments throughout the pandemic has been "good Christians" who roll over and say "well, it's all prophesied so there's nothing we can do." They, the online people wringing their hands, seem to believe that others cannot possibly decide what's best for themselves. I'd like to add that, if the average person was already growing skeptical about the truthfulness and good intentions of the federal government and their media allies as the Scamdemic continues to be exposed for what it was, then the so-called "debate" should only increase their skepticism and willingness to think independently. Those 90 minutes were like Bill Clinton's blue dress moment: indisputable evidence that the Biden administration, the DNC, and their media allies have been blatantly lying and covering up Biden's dementia for years. They thought they could deceive enough of the voting public to pull off a semi-plausible win in November, but instead were exposed as the lying dirtbags they are.
Hmm. I can’t help but think that Biden was “allowed” to go out and perform as he did. The Dems need a solution. Biden is done, but Dems work in remarkable lockstep. It has to be a coordinated event, but appear to be organic. So let Biden be destroyed on National TV (nope, I didn’t watch, because I don’t watch TV) and then they can “begin” to come forward and openly express “concern”. IMO, that's not being paranoid, that's common sense.
We have seen enough, there's nothing about the ongoing destruction of America that has not been planned & fomented for decades by those who think they're smarter than everyone else, even more brilliant than the living God.
Yes, I've seen that put forth as a possibility, but, personally, I'm not buying it. It was too humiliating -- not just for Biden, but for his handlers and the media, being exposed as blatant liars. It also would mean that they purposely chose to deal directly with Kamala or hold an open convention that is likely to be highly contentious, if not violent, with millions of Dems rightfully being angry at being deprived of a choice. To those who believe it was purposeful because the debate was held so much earlier than is typical, I say, it's more likely because Biden's decline is so steep that they couldn't risk holding a debate several more weeks from now.
I think some people cling to power not solely because they are power-mad but because they fear irrelevance. It takes courage to face reality and recognize when your time is up.
To clarify my comment: when I refer to the whole performance as strategic, I am referring to the Dem/Media machine. They let Biden go out on stage knowing the state he is in. They let him go out there without a lifeline. It is truly elder abuse.

100% if you are depending on government paid judges to go against their employer what are you thinking? Sotomeyer has no business on any court - listen to her in court hearings, read her rulings. Its like listening to and reading what a 3rd grader wrote or speaks. Jackson does not know what a woman is, and Kagan while once in a while has an elightening moment for the most part is Sotomeyer 2.0 Most these judges are incapable of intelligent thought, their twisting of words is mind bending. They are incapable of reading simple words and making simple decisions.

I worked in the legal profession for many years as a lowly "secretary"/ paralegal so I am all too familiar with the cesspool of the court system. There's an old saying that a good lawyer is one who knows the law, but a great lawyer is one who knows the judge. In fact, judges are the lowest of the low- they are nothing more than successful politicians who are either elected or appointed by other sleazy pols. There is no justice to be had- ask our friend Mark Steyn what they did to him. Perfect example.
I fully understand why someone like you, having obviously high moral character and wisdom, dropped out to pursue other ways of making a living, but it is a great loss to our side nevertheless. We desperately need Freedom Fighters like yourself, especially with regard to the upcoming "election" that is already set to be stolen by the filthy Demo-Commies.

The bias shown against me in that case and the appellate court's refusal to make things right was an experience I couldn't allow myself to go through again. But like I said, the real losers are the low-income people I would have repped in future cases.

Great one, Mark. Having a JD, although I became an educator instead of a lawyer, I “concur” in your opinion. It became obvious to me in law school that judicial decisions were ultimately discretionary, particularly those involving constitutional issues. Many judges hew the lines in line with constitutional precedent, while others force the square peg into a distorted shape (judgement) of their own making depending upon an outcome that they wish to see. While art may well be in the eyes of the beholder, beauty is universal and people know it when they see it as well as its opposite. Mental health has a lot to do with judgment. It’s not a coincidence that the more fearful and ungrounded people are, the more they appreciate the predations of the safety state and its ruinous proclivities.

I hold onto the belief that the truth will always win out in the end, even if it takes awhile. Repeated lies can never defeat reality. Thank you for this commentary -- I think it's one of your best. I'd like to add that, if the average person was already growing skeptical about the truthfulness and good intentions of the federal government and their media allies as the Scamdemic continues to be exposed for what it was, then the so-called "debate" should only increase their skepticism and willingness to think independently. Those 90 minutes were like Bill Clinton's blue dress moment: indisputable evidence that the Biden administration, the DNC, and their media allies have been blatantly lying and covering up Biden's dementia for years. They thought they could deceive enough of the voting public to pull off a semi-plausible win in November, but instead were exposed as the lying dirtbags they are.
Hmm. I can’t help but think that Biden was “allowed” to go out and perform as he did. The Dems need a solution. Biden is done, but Dems work in remarkable lockstep. It has to be a coordinated event, but appear to be organic. So let Biden be destroyed on National TV (nope, I didn’t watch, because I don’t watch TV) and then they can “begin” to come forward and openly express “concern”. I think that whole performance was strategic. I know it sounds paranoid, but that is how I have come to be since the Scam. I don’t trust anything that comes from Democrats. Well, and most Repubs. I have said my entire adult life: people with power and money like to keep power and money.
I truly don’t understand it, as in grok how someone could just keep wanting more and more, insatiably. If my husband and I had earned a butt load of money, we’d be withdrawn from working life. We’d still farm for good food, travel some, read good books, do good works, hopefully be pleasing in the eyes of God.
To end on a cheerful note: Happy Independence Day! And fight the good fight. Mark is right. We have to resist.

Yes, I've seen that put forth as a possibility, but, personally, I'm not buying it. It was too humiliating -- not just for Biden, but for his handlers and the media, being exposed as blatant liars. It also would mean that they purposely chose to deal directly with Kamala or hold an open convention that is likely to be highly contentious, if not violent, with millions of Dems rightfully being angry at being deprived of a choice. To those who believe it was purposeful because the debate was held so much earlier than is typical, I say, it's more likely because Biden's decline is so steep that they couldn't risk holding a debate several more weeks from now.
I think some people cling to power not solely because they are power-mad but because they fear irrelevance. It takes courage to face reality and recognize when your time is up.
To clarify my comment: when I refer to the whole performance as strategic, I am referring to the Dem/Media machine. They let Biden go out on stage knowing the state he is in. They let him go out there without a lifeline. It is truly elder abuse.

100% if you are depending on government paid judges to go against their employer what are you thinking? Sotomeyer has no business on any court - listen to her in court hearings, read her rulings. Its like listening to and reading what a 3rd grader wrote or speaks. Jackson does not know what a woman is, and Kagan while once in a while has an elightening moment for the most part is Sotomeyer 2.0 Most these judges are incapable of intelligent thought, their twisting of words is mind bending. They are incapable of reading simple words and making simple decisions.
Ultimately it is up to US to straighten out the court system and the political/law making system. Under our system of justice WE have ALL the power, not the judge, not the lawyers WE the person you look at in the mirror. Our system of justice is based on the case of J Peter Zenger. Dear Mark- I have no idea how I became a subscriber, but I am exceedingly grateful to whomever signed me up. You are an incredible and inspiring writer and this essay in particular really got to me. I must say that as a rule lawyers are pretty good writers and you are one of the best.
I worked in the legal profession for many years as a lowly "secretary"/ paralegal so I am all too familiar with the cesspool of the court system. There's an old saying that a good lawyer is one who knows the law, but a great lawyer is one who knows the judge. In fact, judges are the lowest of the low- they are nothing more than successful politicians who are either elected or appointed by other sleazy pols. There is no justice to be had- ask our friend Mark Steyn what they did to him. Perfect example.
I fully understand why someone like you, having obviously high moral character and wisdom, dropped out to pursue other ways of making a living, but it is a great loss to our side nevertheless. We desperately need Freedom Fighters like yourself, especially with regard to the upcoming "election" that is already set to be stolen by the filthy Demo-Commies.
If you see this comment, I wonder if you would be so kind as to let us know your thoughts about the fraud that seems to be "baked in the cake" as we approach the most important election of our lifetime.

The bias shown against me in that case and the appellate court's refusal to make things right was an experience I couldn't allow myself to go through again. But like I said, the real losers are the low-income people I would have repped in future cases.
And I didn't need a legal job. I had other work that I liked.

Great one, Mark. Having a JD, although I became an educator instead of a lawyer, I “concur” in your opinion. It became obvious to me in law school that judicial decisions were ultimately discretionary, particularly those involving constitutional issues. Many judges hew the lines in line with constitutional precedent, while others force the square peg into a distorted shape (judgement) of their own making depending upon an outcome that they wish to see. While art may well be in the eyes of the beholder, beauty is universal and people know it when they see it as well as its opposite. Mental health has a lot to do with judgment. It’s not a coincidence that the more fearful and ungrounded people are, the more they appreciate the predations of the safety state and its ruinous proclivities.

Bravo sir. Not many people are willing to put there money where there mouth is as the old saying goes. You are defenitely a lion amongst sheep. I hold onto the belief that the truth will always win out in the end, even if it takes awhile. Repeated lies can never defeat reality. No matter how many times people laud these jabs, as the bodies and injuries keep piling up, it will become harder and harder to convince people to not believe there lying eyes. Im not sure there will ever be a true reckoning for those that unleashed the destruction of the covid policy, but hold out hope that at lteh very east alot more people can see that the emperor had no clothes the entire time.
